Notary Affidavit

A Notice of the Substitution of Trustee is a notary affidavit that is used to notify the public that a new trustee has been appointed to replace the old trustee in a trust. This affidavit can be used by anyone who has been named trustee in a trust, such as an inheritance trust.

This document should be filed with the county clerk's office in the county where the trust was first established so that anyone who needs to know about the change will find out right away.

A notary public is a public officer appointed by the Governor to serve the people of Georgia. The secretary of state's office appoints notaries, who are required to be residents of Georgia. Before a notary can be commissioned, the applicant must pass a written test and submit to a criminal history check. A new application is required if you change your name or move from one county to another.

You do not need to be a lawyer or a member of the Georgia Bar to become a Notary Public in Georgia. However, it is illegal for anyone who is not an attorney licensed to practice law in this state (or appointed by a court as a limited scope representative) to prepare, draft or otherwise assist anyone in preparing any legal document, including wills, trusts or deeds. You may refer clients to attorneys for further advice and counsel, but you may not prepare any legal documents for them.
